Invero, osserva la Sesta Sezione, la fattispecie dell’abuso di ufficio non contempla, quelle forme di abuso realizzabili dal funzionario senza servirsi in alcun modo dell’attività funzionale da lui svolta, ossia mediante usurpazione o il semplice sfruttamento della sua qualifica soggettiva, della sua posizione o del proprio potere di influenza.
